About us

The Federal Office for Food Safety (BAES) was implemented by the Health and Food Safety Act (Federal Law Gazette I No 63/2002 as amended ). It is associated with AGES and must, in accordance with Section 6 (5) of the Austrian Health and Food Safety Act (GESG), employ the resources available to operate in the execution of the sovereign functions of AGES.


The Federal Office for Food Safety (BAES) is the competent authority for the enforcement of the following sectoral legislation (pursuant to Section 6 (1) of the Health and Food Safety Act):

  • 1: Seeds Act 1997, as amended
  • 2: Planting Material Act 1997, as amended
  • 3: Plant Variety Protection Act 2001, as amended
  • 4: Plant Protection Products Act 2011, as amended
  • 5: Plant Protection Act 2011, as amended
  • 6: Feedstuffs Act 1999, as amended
  • 7: Fertiliser Act 1994, as amended
  • 8: Marketing Standards Act, as amended

 

Appeals against official decisions by the Federal Office for Food Safety may be lodged to the Federal Administrative Court. BAES is a subordinate agency of the Federal Ministry of Agriculture and Forestry, Environment and Water Management. The Federal Minister for Agriculture and Forestry, Environment and Water Management is the supreme authority (pursuant to Section 6 (2) of the Austrian Health and Food Safety Act).


As an authority, BAES shall apply the laws of the General Administrative Proceedings Act pursuant to Section 6 (3) of the Health and Food Safety Act. Furthermore, BAES is a monocratic Federal authority (Section 6 (4) of the Health and Food Safety Act).


In accordance with Section 6 (7) of the Austrian Health and Food Safety Act (GESG), the Federal Office for Food Safety has to publish Official Bulletins and make it accessible to the public concerned in an appropriate manner. In the Official Bulletins, the Federal Office for Food Safety announces the following: official statements according to the sectoral legislations set forth in Section 6 (1) of the Health and Food Safety Act (GESG) as well as public-sector tariffs pursuant to Section 6 (6) of the Health and Food Safety Act (GESG).

Struktur

Das BAES besteht neben dem Direktor und dessen Stellvertretung im operativen Bereich aus den zwei Abteilungen "Überwachung und Kontrolle" und "Rechtsdienst, Zulassung, Zertifizierung und Kommunikation". Tasks and duties of the Federal Office for Food Safety
The tasks and duties of the Federal Office for Food Safety are very diverse. The following list serves as an overview:

  • The control of the placing on the market of seeds, feedstuffs, fertilisers as well as plant protection products (representative sampling and farm/factory inspections)

  • In cases of infringements of sectoral legislation: submission of a complaint, filing of a report or preventive seizures (depending on the subject matter and gravity of the infringement)

  • Authorisations of varieties, seeds, fertilisers and plant protection products as well as seed certification

  • Registration, authorisation and supervision of production holdings

  • Import control of plants, plant products from third countries, examination in connection with the exportation of seeds as well as recognition of plant material

  • Plant Variety Protection Office

  • Export and/or import controls of fruit and vegetables in terms of compliance with marketing standards

  • Monitoring of information provided to consumers within the framework of the common organisation of the markets in fisheries and aquaculture products
